Cost of Divorce and Lawyer Fees in DuPage County
How Much Does Divorce Cost in Illinois?
Divorce cases can be complex, emotional, and, depending on the parties involved, time consuming. It is wise to seek the counsel of an experienced lawyer who can guide you through the process and work to find a successful resolution in the most cost-effective manner possible.
Most clients, who are proceeding with a divorce, ask if we can force their spouses to pay attorneys fees. Unfortunately, it is up to the court. We will routinely ask the judge to award attorneys fees on a temporary (interim) and final basis, but it is ultimately the decision of the court. Commonly, the court will evaluate the financial situation of both parties and render a decision at the conclusion of the proceedings.
The Illinois Marriage and Dissolution of Marriage Act states, in part:
"The court from time to time, after due notice and hearing, and after considering the financial resources of the parties, may order any party to pay a reasonable amount for his own or the other party's costs and attorney's fees." 750 ILCS 5/508 (West 2011).
